New Delhi. Wednesday is going to be a very important day in the current session of Parliament. The Central Government is going to introduce three major bills in the House today, which will have a direct impact on the Prime Minister, Union Ministers and Chief Ministers or Ministers of Union Territories. According to the proposed provisions, if any person holding a top post is arrested or detained in serious criminal cases, he will have to resign from his post.
Amit Shah will present the proposal
Union Home Minister Amit Shah will introduce these bills in the Lok Sabha. Also, he will also propose to send these bills to a joint committee of Parliament so that they can be discussed and examined in detail.
Government of Union Territories (Amendment) Bill 2025
This amendment bill related to the governments of Union Territories clarifies that the existing law, i.e. the Government of Union Territories Act, 1963, does not provide for the removal of a Chief Minister or Minister from office in the event of arrest or detention in serious criminal cases. To overcome this deficiency, it has been proposed to amend Section-45.
Constitution (130th Amendment) Bill 2025
The objective of the Constitution Amendment Bill is even broader. It states that at present, Article-75, Article-164 and Article-239AA of the Constitution lack any such provision, under which the Prime Minister, Union Minister, Chief Minister or Minister of the State and Chief Minister or Minister of Delhi can be removed from office after arrest on serious criminal charges. Through this amendment, an attempt is being made to fill this legal void.
Jammu and Kashmir Reorganization (Amendment) Bill 2025
Through this bill, it is proposed to change the Jammu and Kashmir Reorganization Act, 2019. There is no clear provision in the existing law that if the Chief Minister of Jammu and Kashmir or any minister is arrested under serious criminal charges, then he should be removed from office. To overcome this deficiency, Section-54 will be amended.
Political and Constitutional Importance
These three bills are not only being considered as a step towards strengthening the constitutional framework, but will also ensure accountability of persons in high positions of power. Experts believe that if these amendments are passed, it will be impossible for leaders facing serious criminal charges to remain in office in future.
